Welcome to Her Holistic Coach (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website, www.herholisticcoach.site (the “Site”), and the services, packages, and digital products we offer (collectively, the “Services”).

By accessing the Site or purchasing our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use our Site or Services.

1. Important Health and Medical Disclaimer

This is a crucial component of our agreement. You must read and understand the following:

• Not Medical Advice: The content on the Site and the advice provided through our Services are for informational and educational purposes only. Her Holistic Coach provides non-medical advice and guidance.
• Not Treatment: Our Services are not, and should not be considered, medical advice, diagnosis, or treatment for any physical or mental health condition. We are not a medical or mental health provider.
• Consult a Professional: You are required to consult with a licensed health professional (such as a doctor, physician, therapist, or psychiatrist) for any medical or mental health concerns. Our Services are not a substitute for professional medical care, evaluation, or treatment.
• Personal Responsibility: Never disregard professional medical advice or delay in seeking it because of information you have received from Her Holistic Coach or on our Site. You are solely responsible for your health decisions and outcomes.

2. Our Services

Her Holistic Coach provides coaching and guidance related to holistic wellness, lifestyle, nutrition, and personal development. Our role is to support and assist you in reaching your own goals, but your success depends primarily on your own effort, motivation, and follow-through.

3. Payments, Refunds, and Transfers

Our policy regarding payments is strict and binding upon purchase.

• Non-Refundable: All payments for packages, services, and digital products are final and 100% non-refundable. Once a Service or package is purchased, no refunds will be issued for any reason, including if you choose to terminate the services early.
• Non-Transferable: All Services and packages are non-transferable. They must be used by the individual who purchased them (the “Client”) and cannot be transferred, gifted, or assigned to any other person.

4. Session Cancellation and Rescheduling

We understand that life happens, but we require a firm policy to respect each other’s time.

• We require a minimum of 24 hours’ notice to reschedule any one-on-one coaching session.
• Sessions cancelled or missed by the Client with less than 24 hours’ notice will be forfeited and considered used.
• If Her Holistic Coach must cancel a session, we will provide at least 24 hours’ notice and the session will be rescheduled at a mutually convenient time.

5. Client Responsibilities

To use our Services, you represent and warrant that:

• You are at least 18 years of age.
• You will provide complete and accurate information about yourself and your health history.
• You understand and agree to the Medical Disclaimer in Section 1.
• You are fully responsible for your own well-being during and after coaching sessions, and for all decisions you make as a result of the Services.

6. Limitation of Liability and Indemnification

This section limits our liability to you.

• Limitation of Liability: Her Holistic Coach (including its founder, employees, and affiliates) shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Site or our Services. This includes, but is not limited to, any personal injury, health outcome, or financial loss.
• No Guarantees: We make no guarantees, representations, or warranties regarding your results from our Services. Any testimonials or examples shown on the Site are not a guarantee of future results.
• Indemnification: You agree to indemnify, defend, and hold harmless Her Holistic Coach from any and all claims, demands, losses, or liabilities (including legal fees) arising out of your breach of these Terms, your use of our Services, or your violation of any law or the rights of a third party.
• Release of Claims: By using our Services, you hereby release Her Holistic Coach from any and all claims, demands, or causes of action related to any damages or injuries (physical, mental, or financial) that you may experience in connection with our Services.

7. Intellectual Property

All content on the Site and provided as part of the Services, including text, graphics, logos, worksheets, and course materials, is the exclusive property of Her Holistic Coach and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

8. Confidentiality

We are committed to protecting your privacy. Any personal or sensitive information shared by you during coaching sessions will be kept confidential, subject to the limitations outlined in our Privacy Policy and as required by law (e.g., if there is a risk of harm to yourself or others).

9. Term and Termination

We reserve the right to terminate or refuse our Services to anyone for any reason at our sole discretion. This includes, but is not limited to, a breach of these Terms, non-payment, or disrespectful conduct. If we terminate the Services, you will not be entitled to a refund for any payments already made.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland/Australia, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Queensland.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you by posting the updated terms on this Site. Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms.
